Terms of Use

These Terms of Use ("Terms") govern your access to and use of Arka Seeker, including the mobile application available on the Solana dApp Store and Google Play Store, and the website at arkaseeker.com (collectively, the "App"). By downloading, installing, or using Arka Seeker, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Who We Are

Arka Seeker is developed and operated by Matthew Harvey (Wollammo Productions) ("we," "us," or "our"), based in Lisbon, Portugal. You can contact us at info@arkaseeker.com.

2. Eligibility

You must be at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is higher) to use Arka Seeker. By using the App, you represent and warrant that you meet this requirement.

You are solely responsible for ensuring that your use of the App, including any wagering features, complies with all applicable laws and regulations in your jurisdiction. Arka Seeker is not available to users in jurisdictions where cryptocurrency wagering or gambling is prohibited by law.

3. Description of the App

Arka Seeker is a competitive brick-breaking mobile game. The App includes:

• Free gameplay — leaderboards, daily streaks, and competitive scoring at no cost.
• Weekly Tournaments — optional paid entry (0.05 SOL) with prize pools distributed to top finishers.
• PvP Challenges — optional peer-to-peer wagering using SOL cryptocurrency, facilitated by a Solana smart contract (escrow program).
• In-App Purchases (IAP) — cosmetic items (paddle skins, ball trail skins), Remove Ads, and Extra Lives, priced in USD and paid in SOL at the prevailing exchange rate.

4. Cryptocurrency and Wagering

By using the wagering features, you acknowledge and agree that:

• Tournament entries and PvP stakes involve real SOL with real monetary value.
• Tournament prizes and PvP payouts are subject to a house rake (10% for tournaments, 5% for PvP). Winners receive the net amount after rake.
• All transactions are executed on the Solana blockchain and are irreversible once confirmed on-chain.
• PvP stakes are held in a non-custodial smart contract escrow. We do not hold your funds — the escrow program enforces the rules automatically.
• We are not a licensed gambling operator, financial institution, or money services business. We do not provide investment advice.
• Cryptocurrency values fluctuate. The USD value of any SOL you wager or win may change at any time.
• It is your sole responsibility to report and pay any taxes applicable to cryptocurrency winnings in your jurisdiction.

5. In-App Purchases

In-App Purchases are processed via Solana Pay. Prices displayed in USD are converted to SOL at the prevailing exchange rate at the time of purchase. All IAP sales are final — cosmetic items and entitlements are non-refundable once granted.

If a purchase fails to credit due to a technical error, please contact us at info@arkaseeker.com with your Solana wallet address and transaction signature.

6. User Conduct

You agree not to:

• Use cheats, bots, scripts, or any automated means to manipulate scores or gameplay.
• Attempt to exploit, reverse-engineer, or interfere with the App or its backend systems.
• Use multiple accounts to circumvent referral, streak, or promotional systems.
• Engage in abusive, harassing, or fraudulent behavior toward other players.

We reserve the right to ban accounts that violate these rules, with or without notice, and with no obligation to refund any SOL held in active escrow positions.

7. Anti-Cheat and Score Integrity

Arka Seeker employs server-side anti-cheat verification on all scored runs. Scores that fail verification are rejected and do not qualify for leaderboard placement, tournament prizes, or PvP payouts. Repeated anti-cheat violations may result in account suspension.

8. Intellectual Property

All content within Arka Seeker — including but not limited to artwork, audio, code, game mechanics, and branding — is owned by or licensed to Wollammo Productions. You may not copy, modify, distribute, or create derivative works without express written permission.

9. Disclaimer of Warranties

Arka Seeker is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free from security vulnerabilities. We make no warranty regarding the continued operation of the Solana network or any third-party services (including Helius RPC, CoinGecko, or Phantom wallet).

10. Limitation of Liability

To the fullest extent permitted by applicable law, Matthew Harvey (Wollammo Productions) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Arka Seeker, including but not limited to loss of SOL, loss of data, or lost profits — even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms shall not exceed the greater of (a) the total amount you paid us in IAP purchases in the 30 days preceding the claim, or (b) €10 EUR.

11. Blockchain Irreversibility

All on-chain transactions — including tournament entries, PvP deposits, and IAP payments — are final and irreversible once confirmed on the Solana blockchain. We cannot reverse, cancel, or refund transactions that have been confirmed on-chain, except where the smart contract logic expressly provides for a refund (e.g. an unaccepted PvP challenge that expires).

12. Third-Party Services

Arka Seeker integrates with third-party services including the Solana blockchain, Firebase (Google), Helius RPC, CoinGecko, and the Phantom wallet. Use of those services is subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

13. Privacy

We collect minimal data necessary to operate the App (anonymous Firebase Auth UID, FCM push token, in-game scores, and wallet addresses you voluntarily link). 14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Portugal, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Lisbon, Portugal.
